The outcome of the Ofcom Digital Communications review was announced on 10th March 2017.

Agreement has been reached between BT and Ofcom that 32,00 of our represented grades will be transferred from BT PLC into Openreach Limiited, which will be a distinct legal seperation and set up as a subsidiary of BT Group. Our members terms and conditions will be unaffected by that transfer, but will become employees of Openreach Limited.

This removes the uncertainty that has surrounded the outcome of the review since it was announced during 2016. Nothing will happpen straight away, not until pre-conditions are met and that could take some time. Further announcements from Ofcom are due over the next week. Thoss pre-conditions are:

  • Arrangements are put in place for people to continue in their pernsion scheme when they transfer to Openreach Limited, including an extension to the Crown guarantee.

  • The BT Pension Scheme Trustee consent to Opnereach Limited becoming a participating employer in the pension scheme.

  • Consultation with the CWU and Propsect relating to the TUPE transfer of people to Openreach Linited.

 

TUPE protects terms and Conditions when employers change and they are required to consult with the recognised unions before transfer takes place. The CWU will be making strong representations to ensure T&C's ane job security are fully protected.
